Welcome to Sytegeist. By accessing this website or using my services, you agree to the following Terms & Conditions. Please read them carefully.

1. About Sytegeist

Sytegeist is a web design and digital strategy studio owned and operated by Lyne Kolb. I provide website design, website refreshes, branding support, website care services, and related digital services for small businesses.

2. Acceptance of Terms

By visiting this website, submitting an inquiry, purchasing services, or working with Sytegeist, you agree to these Terms & Conditions.

If you do not agree, please discontinue use of this website and my services.

3. Project Agreements

Each client project is governed by its own proposal, agreement, invoice, and any documented project scope.

If there is ever a conflict between these Terms & Conditions and a signed client agreement, the signed agreement will take precedence.

4. Quotes & Pricing

Project estimates and package pricing are provided based on the information available at the time of quoting.

Changes to the project scope, requested features, or additional revisions may require a revised quote or additional billing.

Prices are subject to change for future projects but will not affect an already accepted proposal unless both parties agree.

5. Payments

Payment terms are outlined within each project proposal or invoice.

Projects generally begin once the required deposit has been received.

Final files, website launch, or transfer of ownership may be withheld until outstanding balances have been paid.

Late payments may delay project timelines.

6. Revisions & Scope Changes

Each package includes the revisions outlined in your proposal.

Requests that fall outside the agreed project scope or exceed included revisions may be billed separately.

Additional work will always be discussed before charges are incurred.

7. Client Responsibilities

To help keep projects on schedule, clients agree to:

• Provide requested content, images, and branding materials

• Review work and provide feedback in a timely manner

• Supply accurate information

• Maintain ownership or appropriate licensing for all submitted content

Delays in receiving required materials or approvals may impact the project timeline.

8. Intellectual Property

Unless otherwise agreed in writing:

• Clients retain ownership of the content, logos, images, branding assets, and other materials they provide for their project.

• Upon final payment, clients receive ownership of the completed custom website design and deliverables created specifically for their project.

• Sytegeist retains ownership of any pre-existing templates, design systems, workflows, processes, and other proprietary materials used in the creation of your project unless otherwise specified.

• Unless otherwise requested in writing, Sytegeist reserves the right to showcase completed projects, including screenshots, project descriptions, and publicly accessible website links, in its portfolio, social media, marketing materials, presentations, and case studies for promotional purposes.

• If a project is confidential or has not yet been publicly launched, clients may request in writing that their project not be featured.

Third-party software, website platforms, fonts, plugins, stock photography, icons, templates, or other licensed assets remain subject to their respective licenses and terms of use.

9. Third-Party Services

Projects may incorporate third-party services including website platforms, payment processors, domain registrars, analytics providers, scheduling tools, or email marketing platforms.

Sytegeist is not responsible for outages, pricing changes, policy updates, security incidents, or service interruptions caused by these third-party providers.

10. Website Care Plans

Website Care Plans are ongoing monthly or quarterly services designed to help maintain and support your website after launch.

Care Plans do not include new website builds or major redesigns unless specifically stated.

Unused included support time does not roll over unless otherwise agreed in writing.

11. Artificial Intelligence

To improve efficiency, brainstorming, organization, research, drafting, or other creative workflows, I may responsibly use artificial intelligence (AI) tools during portions of a project.

All final work is reviewed, edited, and approved by me before being delivered to clients.

Client information is handled responsibly, and confidential information is not intentionally shared with public AI systems beyond what is necessary to provide my services.

12. Website Availability

While I strive to build reliable, high-quality websites, I cannot guarantee uninterrupted website availability, search engine rankings, visitor traffic, or business outcomes.

Many factors affecting website performance are outside my control.

13. Limitation of Liability

To the fullest extent permitted by law, Sytegeist shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of this website or my services.

My total liability shall not exceed the amount paid for the specific service giving rise to the claim.

14. Changes to These Terms

These Terms & Conditions may be updated from time to time.

The most current version will always be available on this website.
